Unscrupulous employers are increasingly using ICE threats against workers who raise issues regarding wages or working conditions, according to recent reports. California labor authorities reveal that approximately 200 reports of immigration-related employer intimidation have been filed since 2025, rivaling the total number recorded during the entire Biden administration. More than 460 such threats were also reported during the first Trump administration.

This alarming tactic is most prevalent in industries heavily reliant on undocumented and low-wage labor, such as construction, hospitality, and domestic care. Labor experts point out that recent crackdowns by federal immigration authorities have heightened deportation fears, which some employers now exploit. As reported by KQED, a construction worker named Francisco faced ICE threats while cooperating with a labor investigation into a colleague’s complaint. Fearing deportation for himself and his family, Francisco suffered severe anxiety requiring psychiatric care.

Legal Protections and Employer Penalties

According to organizations like the Coalition for Humane Immigrant Rights (CHIRLA), represented by Yunuen Trujillo, employers utilize these tactics to commit wage theft and maintain control over vulnerable laborers. Both federal and California laws guarantee core labor rights—including minimum wage, overtime, and safe working conditions—regardless of immigration status, making retaliation strictly illegal. California labor authorities have warned that employers confirmed to have used ICE threats against workers face penalties of up to $10,000 per violation.
