The EB-5 investment immigration fee is set to increase significantly, according to a recent announcement. On September 29, U.S. Citizenship and Immigration Services (USCIS) revealed that the EB-5 visa application fee will rise from the current $3,675 to $7,615, marking a 107% increase.

New Fee Schedule and Effective Date

The adjusted fees will take effect starting November 30. This change is expected to impact approximately 16,600 EB-5 visa applicants annually. In addition to the application fee hike, USCIS is introducing a new form (I-527) for existing investors whose projects have failed, allowing them to maintain their immigration status for a filing fee of $10,330.

USCIS Rationale for Fee Adjustments

USCIS stated that the agency funds the majority of its operating expenses—including application processing, identity verification, and fraud detection—through filing fees rather than tax revenue. The agency explained that this increase is necessary to cover the operational costs of the EB-5 program, reduce document processing times, and strengthen auditing and site inspections.
